New federal identity theft laws have been passed which are holding business owners liable criminally and civilly for failing to protect their employees’ and customers’ identities.

These laws require, among other things, continual education on the treatment of confidential information in the workplace, and stringent control and implementation of safeguards to ensure such confidential information is protected.

These new laws include:

1. The Fair and Accurate Credit Transactions Act Disposal Rule (FACTA).
2. Identity Theft Red Flags and Address Discrepancies Rule.
3. The Health Insurance Portability and Accountability Act Security Rule (HIPAA).
4. The Gramm-Leach-Bliley Safeguards Rule (GLBA).
