Disability-related claims are at an all time high. The EEOC recently reported a 17 percent increase in disability charges, and such claims now account for a third of all discrimination charges filed in California. Within these numbers, a more disturbing trend exists -- a steep rise in claims alleging discrimination based on mental disability.

Managing employees with mental disabilities is one of the most challenging issues in today's workplace. Employees are understandably reluctant to disclose their conditions, and the law limits an employer's ability to ask. Without a meaningful dialogue, however, it is virtually impossible to engage in the interactive process - much less find a reasonable accommodation.
